US President Donald Trump has extended the restriction requiring a $100,000 payment for certain new H-1B visa petitions for another 12 months. The measure, originally introduced in September 2025, will now remain in effect until September 21, 2027, unless extended further.
The requirement primarily applies to H-1B workers who are outside the United States when their employers file petitions. The proclamation provides limited exceptions when the US government determines that an exemption is in the national interest. Current H-1B holders are not covered by this new payment requirement for their existing visas or renewals.
The extension comes while legal challenges to the $100,000 payment continue in US courts. A federal judge had previously ruled against the fee, and an appeal is under consideration.
