Two days after the devastating Malviya Nagar fire claimed 21 lives, the Delhi government on Friday announced stringent measures to fix accountability, warning that officials found responsible for negligence could face not only disciplinary action but also personal financial liability.

The decision was taken during a high-level review meeting chaired by Chief Minister Rekha Gupta. The government stated that losses resulting from illegal constructions and serious safety violations could be recovered from both property owners and officials who failed to take action against such violations.

Government Invokes Legal Provisions

Home Minister Ashish Sood said the government would invoke provisions of the Revenue Recovery Act, 1819, and the Disaster Management Act, 2005, to strengthen enforcement and accountability.

“Any losses arising from illegal constructions or violations will be recovered from both the property owners and the officials found responsible,” Sood said after the meeting.

The move comes as investigators continue to examine whether illegal construction, regulatory lapses, and fire safety violations contributed to one of Delhi’s deadliest fire incidents in recent years.

Focus Shifts to Accountability of Officials

The tragedy has once again raised questions about how building and safety violations often go unchecked despite oversight by multiple agencies.

Officials said discussions during the meeting focused on the role of agencies such as the Municipal Corporation of Delhi (MCD), Delhi Fire Service, Delhi Police, power distribution companies, and local administration.

The government believes that overlapping responsibilities among departments often make it difficult to fix accountability after such incidents.

District Magistrates Given Greater Powers

To improve coordination and enforcement, the government has decided to strengthen the powers of District Magistrates (DMs).

Under the new measures, DMs will be empowered to coordinate action among departments, identify lapses, recommend disciplinary proceedings, issue show-cause notices, and ensure prompt action against violations.

“A key decision was taken to strengthen the powers of District Magistrates to ensure better coordination and unified action across departments and agencies,” Sood said.

Officials May Face Financial Recovery and Prosecution

One of the most significant decisions announced by the government is that officials found guilty of negligence, collusion, or failure to act may face recovery proceedings from their salaries, pensions, retirement benefits, or personal assets.

The government also warned that serious violations could attract prosecution under the Disaster Management Act.

“If any official is found complicit, negligent, or involved in collusion, stringent action, including prosecution and imprisonment, may be initiated as per the law,” the Home Minister said.

Hotels, Guest Houses and Commercial Properties Under Scrutiny

The government has ordered extensive inspections of hotels, guest houses, restaurants, banquet halls, and Bed & Breakfast establishments across Delhi.

Joint teams comprising officials from the Delhi Fire Service, Delhi Police, MCD, and other departments will conduct inspections under the supervision of District Magistrates.

Authorities have also been directed to take immediate action against establishments operating without necessary approvals or violating building and safety regulations.

Buildings found violating sanctioned plans, building bye-laws, or approved construction limits could face sealing or demolition.

Enforcement Drive Intensifies

According to the MCD, since June 1, authorities have demolished 82 properties and sealed 43 others as part of a citywide drive against unauthorized construction and building norm violations.

More than 150 notices, sealing orders, and demolition notices have also been issued.

In South Delhi, where the Malviya Nagar tragedy occurred, officials have identified several Bed & Breakfast establishments allegedly operating in violation of regulations. Some establishments in Hauz Rani have already been sealed, while further action is planned in Said-ul-Ajaib and Khirki Extension.

A Test of Accountability

The Malviya Nagar fire has once again highlighted concerns over illegal constructions and fire safety compliance in the national capital.

While the government’s latest measures signal a tougher stance on accountability, the effectiveness of the initiative will depend on whether action extends beyond property owners to officials responsible for overlooking violations.
